Texas Freeze Claims

Texas faced an unprecedented weather event this month. With most of the state covered in ice and snow and millions without power or water, many Texans suffered and continue to suffer like never before. The situation is unique because unlike other catastrophes such as hurricanes or hail storms, it impacted all of Texas at once. Even though most residents have had power and water restored, many are dealing with burst pipes, flooded homes, and all the damage that follows. Others are struggling to find food, battling long grocery store lines and a crippled supply chain. Ambulances in San Antonio were unable to meet surging demand, and the county government in Galveston called for refrigerated trucks to hold bodies found in freezing, powerless homes. How bad is it? Both the state and federal governments have issued disaster declarations, and the President has authorized FEMA to coordinate aid with Texas state officials.

Unfortunately, for many Texans, this is just the beginning. The next storm brewing is the one homeowners and businessowners may face when they call on their insurers to address the property damage the storm caused.

Insurance Claims in the Wake of the Texas Freeze

Texas insureds must now file claims and begin the process of determining the extent of the damage to their homes and businesses. Given the widespread damage across the state and the volume of claims, getting back to pre-loss conditions will take more time than normal. Unfortunately, in some cases, insureds will be forced to sue their insurance carriers in order to be made whole. The Insurance Council of Texas, a trade association that represents 400 insurance carriers statewide, has said that this winter storm will be the largest insurance claim event in Texas history – bigger than Hurricane Harvey or any other hurricane or other storm. Insurers will pay out billions of dollars in claims, but they won’t necessarily do it without a fight. Insureds can expect their insurance companies or corporate defendants to look to escape liability, underpay claims, and cut corners in the adjustment process. In some instances, the insurer’s reason for denying a claim or paying less than the insured seeks will be legitimate. In many others, it will not be. That’s when policyholders will need help.

What To Do If You Have Damage

  • FILE A CLAIM. Now. Do not wait. Time is not on your side. Filing a claim triggers certain deadlines for your carrier to act, investigate, and decide. Even worse, some policies have deadlines within which you must file a claim - sometimes in as little as 48 hours. In the event of a catastrophe, this can be nearly impossible to do. Insurers don’t care; if you file “late,” they will use it against you. Plus, there is no downside to filing a claim if you have damage. Your carrier should not drop you for filing a weather-related claim. Unlike punishment for bad driving, the freeze was not your fault. If it does drop you, you can report the behavior to the Texas Department of Insurance or let us know and we will do it for you.

  • DOCUMENT THE DAMAGE. Take as many photos and as much video as you can. Photos and video are often the best proof of property damage. If you have receipts, credit card statements, or any other items that show what you spent on a lost item, organize them. If others have estimated the damage for you – like a contractor, remediator, or third-party adjuster – keep that in your file, too. Correspondence with your insurance agent, insurance company, or anyone else who has helped you with the claim in any way should also be documented and kept. Even if the communications seem unimportant, they may become important later for reasons that are not obvious to you now. Err on the side of keeping everything related to the claim.

  • KEEP A FILE. Organize everything. Photos. Correspondence. Estimates. Video. Money spent. Use simple categories that will help you later if you need to fight with your insurance company.
